What Are Conveyancer-Certified eSignatures?

The HM Land Registry now accepts e-signatures for several documents related to its property dealings, which are known as conveyancer-certified e-signatures. They are accepted by the Registry as long as certain requirements are met, including the below:

  • The conveyancer must provide the Land Registry with a certificate concerning the signature.
  • The signing requires the use of a platform like E-Sign that manages the electronic signing process including creating an e-signature.
  • A conveyancer must represent all parties including those that are not signing the document.
  • The platform must utilise multi-factor authentication as the Land Registry requires signatories and witnesses to have a one-time password (OTP) that is a minimum of 6 numbers.

Steps For The Conveyancer-Certified Signature Process

There are multiple different steps in the process for the Land Registry to accept conveyancer-certified e-signatures, with E-Sign’s capabilities meeting all the requirements set out. Conveyancers must be responsible for setting up and managing the process through the platform and follow these steps:

  • Upload the agreed copy of the document to the platform.
  • Populate with the name, email address, and phone number of the signers and witnesses. The details can be populated later by the relevant signatory.
  • Highlight the required fields for completing/signing within the document, and confirm who they are to be completed by, and in a specified order (witnesses after the signatories).
